Liability Waiver & Release

1. Assumption of Risk

The property at 187 Bradshaw Road, L'Amable, Ontario (the "Property"), including the Bunkie, the surrounding meadow, driveway, deck, forest, and any nearby water features, is a rural, semi-rustic setting. By staying at or visiting the Property, you acknowledge and accept that activities on and around it carry inherent risks, including but not limited to:

  • Uneven or unlit terrain, the gravel driveway, and outdoor steps or decking;
  • Exposure to wildlife, insects, and plant life typical of rural Ontario;
  • Use of a wall-mounted heater and other on-site heating or cooling equipment;
  • The Property has no running water or indoor plumbing — drinking and wash water is provided via water jugs, and an outhouse is provided in place of an indoor toilet;
  • Proximity to natural water features, which may have uneven footing, cold water, or variable depth;
  • Weather conditions, seasonal hazards (including ice and snow), and limited cell/data coverage;
  • Activities undertaken off the Property in the surrounding area (swimming, hiking, rockhounding, snowmobiling, and similar), which are entirely outside the host's control.

You agree that you are voluntarily choosing to stay at and use the Property and surrounding area with full knowledge of these risks.

2. Release of Liability

To the fullest extent permitted by law, you, on behalf of yourself and any guests staying with you (including minors under your supervision), release and forever discharge the owner(s) of the Property, their agents, and representatives from any and all claims, demands, damages, actions, or causes of action arising out of or related to any loss, damage, injury, or death that may occur while on or near the Property, except where caused by the gross negligence or willful misconduct of the owner.

3. Indemnification

You agree to indemnify and hold harmless the owner(s) of the Property from any claims, losses, liabilities, or expenses (including reasonable legal fees) arising from your stay, your actions, or the actions of your guests, except to the extent caused by the gross negligence or willful misconduct of the owner.

4. Property Rules & Use at Your Own Risk

  • Guests are responsible for supervising children and pets at all times.
  • The Bunkie and Property should be treated with care; guests are responsible for damage beyond normal wear and tear.
  • Any off-property activities suggested on this website (swimming spots, trails, rockhounding sites, etc.) are provided as general information only, are not operated or maintained by the owner, and are used entirely at the guest's own risk and discretion.
  • Smoking, open flames, and fireworks are prohibited on the Property unless explicitly agreed in advance.

5. Acknowledgment

By checking the waiver box during booking, or by staying at the Property, you confirm that you have read, understood, and agreed to this Liability Waiver & Release on behalf of yourself and all members of your party.
